Data Protection Declaration

1. Privacy policy

The protection and security of your personal data is extremely important to us. In this privacy policy, we, HR Campus AG (hereinafter also referred to as "we" or "us"), explain how and why we process your personal data. This Privacy Policy applies, among other things, when you visit our website, purchase our services or products, participate in our events or otherwise contact us, e.g. via social media. This is not an exhaustive list; other privacy policies may regulate more specific matters. Personal data refers to all information that relates to a specific or identifiable person.

If you transmit or disclose data of other persons (e.g. family members, data of work colleagues, etc.) to us, please ensure that these third parties are aware of this data protection declaration, that you are authorised to pass on the data and that the data is correct. Your personal data will be processed in accordance with the statutory provisions.

2. Information about the controller

We are responsible under data protection law for the data processing described in this privacy policy, unless otherwise stated. You can contact us as follows for your data protection concerns and to exercise your rights, such as your right to information, your right to correct incorrect data or your right to object:

3. Collection and processing of personal data

We primarily process the following categories of personal data:

  • Master and identification data (e.g. name, telephone number, e-mail addresses, postal address, date of birth, details of function in the company, copies of ID cards, details of relationship with us, official documents (such as extracts from the commercial register, licences));
  • Communication (e.g. physical or electronic correspondence);
  • Contracts: Data arising in connection with the conclusion or performance of a contract (e.g. details of a service purchased/provided and remuneration);
  • Technical data (e.g. IP address of the end device from which you use our website or other electronic offers, including login information, browser used, date and time);
  • Financial data (e.g. information on the booking of remuneration for a service received/provided, bank or postal account, debt collection and debt collection);
  • Data in connection with applications for a job offer (this includes, for example, letters of recommendation and/or application, letters of motivation, job references, references or extracts from the debt collection register);
  • Registration data: Certain offers and services can only be used with a user account or registration, which can be done directly with us or via our external login service providers. In doing so, you share certain data with us and we collect data about the use of the offer or service. We may also collect data about who participates in events or promotions and when;
  • Behavioural and preference data: We use your data about your behaviour and preferences. We do this by evaluating data about your behaviour in our area. Data about certain actions such as your interaction with our social media profiles and your participation in sweepstakes, competitions and similar events;
  • Other data: Photos, videos and sound recordings in which you may be recognisable (e.g. at events, through security cameras etc.).

We obtain much of the data mentioned in section 3 through your voluntary provision of information (e.g. via forms, in the context of communication with us, in connection with contracts, when using the website, etc.). If you wish to conclude contracts with us or make use of Services, you must also provide us with data as part of your contractual obligation under the relevant contract, in particular master data, contract data and registration data. When using our website, the processing of technical data is unavoidable. However, in the case of behavioural and preference data, you generally have the option of objecting or not giving your consent.
To the extent permitted, we also obtain data from publicly accessible sources (e.g. debt collection registers, land registers, commercial registers, Media or the Internet including social media) or receive data from authorities and other third parties (such as address dealers, associations, contractual partners, Internet analysis services, etc.). In individual cases - as far as legally permissible - we also obtain data from third parties, e.g. via online presences that are intended to present the professional qualifications of their members and have a direct connection to your person (e.g. Xing, LinkedIn etc.) as well as feedback from customers and reference providers. Reference information will only be obtained with your prior and express consent.

4. Purposes of data processing and legal bases

We process your data primarily to fulfil our contracts or to protect our legitimate interests. However, we also process data for other purposes, in particular the following:

  • Offer and Development of our offers, services and websites, apps and other platforms on which we are present;
  • in connection with communication with you, in particular to respond to enquiries and assert your rights and to contact you in the event of queries
  • Examination and optimisation of procedures for needs analysis for the purpose of direct customer contact and the collection of personal data from publicly accessible sources for customer acquisition;
  • Advertising/marketing and relationship management, insofar as you have consented to the use of your data or you already have a contractual relationship with us (e.g. to send you personalised advertising from us or to inform you by telephone or email about interesting vacancies. This may also be in the form of newsletters or invitations to events and competitions);
  • to comply with laws, directives and recommendations from authorities and internal regulations ("compliance")
  • for other purposes, e.g. as part of our internal processes and administration or for training and quality assurance purposes;

If you have given us your consent to process your personal data for specific purposes, we will process your personal data within the scope of and based on this consent. Consent that has already been granted can be revoked at any time. However, this has no effect on data processing that has already taken place.
We only process your personal data if and insofar as this is necessary to fulfil our contractual obligations, to protect our legitimate interests or to comply with legal requirements. The processing of your data for other reasons requires your consent.

5. Disclosure of personal data and data transfer abroad

We also transfer data to third parties, in particular to the following categories of recipients

  • Dealers, suppliers
  • Media
  • Public authorities
  • Banking institutions and payment service providers, debt collection companies
  • Other persons: Cases in which the inclusion of third parties results from the purposes set out in section 4.

These recipients are not only located in Switzerland. You and your subcontractors may also process your data abroad, such as in the EU, the EEA or worldwide.
If a recipient is located in a country without an adequate level of data protection, we contractually oblige the recipient to comply with the applicable data protection and level of protection. For this purpose, we use the revised standard contractual clauses of the European Commission, which are available at https://eur-lex.europa.eu/eli/dec_impl/2021/914/oj?, unless the recipient is already subject to a legally recognised set of rules to ensure data protection and we are not relying on an exemption clause. An exception may exist in the following cases: Legal proceedings abroad, in cases of overriding public interests, if the fulfilment of a contract requires such disclosure, if you have given your consent or if the data in question has been made generally accessible by you and you have not objected to its processing.

6. Duration of storage

We process your data for as long as our processing purposes, the statutory retention periods or our legitimate interests in processing for documentation and evidence purposes require it or storage is technically necessary. If there are no legal or contractual obligations to the contrary, we delete or anonymise your data after the storage or processing period has expired as part of our internal data protection processes.

7. Data security

We take appropriate security measures to protect the confidentiality, integrity and availability of your personal data, to protect it against unauthorised or unlawful processing and to counteract the risks of loss, unintentional modification, unwanted disclosure or unauthorised access. Our employees and the third parties commissioned by us are obliged to maintain confidentiality and to comply with the provisions of the applicable data protection laws.

8. Your rights

The applicable data protection law grants you various rights in connection with your personal data. You can exercise your rights by sending your request to the following e-mail address or to the address stated in section 2: dataprotection@hr-campus.ch. Please ensure that we are able to clearly identify you.

  • Right to information and access: You have the right to request information from us as to whether and which of your data we are processing;
  • Right to rectification and erasure: You have the right to request the rectification or erasure of your personal data;
  • Data portability: You have the right to request that we provide you with certain personal data in a commonly used electronic format or transfer it to another controller;
  • Right to object: You have the right to withdraw your previously given consent, insofar as our processing is based on your consent.

9. Cookies

We use various tools for marketing activities. When using these tools, your browser establishes a connection to the servers of the providers of these tools. Through this process, the respective provider receives the information that your browser has accessed the corresponding page of our website. The data transmitted in this process also includes log data from your browser. The provider or its server may be located outside Switzerland, the EU or the EEA (e.g. in the USA). The roughly described data exchange takes place via a third-party cookie.

We also use analysis tools such as Google Analytics (Google LLC, based in Ireland) or comparable services on our website. The information collected about the use of the website is stored on the tool provider's servers. With the help of the analysis tools, we are able to measure and evaluate the use of the website (not personalised). This enables us to find out when and from which Area which pages were accessed. Other data that is collected includes, for example, the file names of the files accessed, the browsers used, the functions used and the time spent on the website. If prior consent was requested when visiting our website (e.g. consent to the storage of cookies), the processing is based on your consent, which you can revoke at any time for the future.

9.1. Social media presence

We also use plug-ins from social networks such as Facebook, Twitter, YouTube, Instagram, Xing, LinkedIn and Vivemo on our websites. This is visible to you in each case (typically via corresponding icons). We have configured these elements so that they are deactivated by default. If you activate them by clicking on them, the operators of the respective social networks can register that you are on our website and can use this information for their own purposes. The data you enter on our social networks will be published by these online platforms. We reserve the right to delete content should this be necessary. The operators of the respective social networks may use advertising tracking methods. The processing of your personal data is the responsibility of this operator in accordance with its data protection regulations.

10. Adaptation of this privacy policy

This privacy policy is not part of a contract with you. We may amend this privacy policy at any time. The version published on this website is the current version.
